Apple’s trade-secrets case against OpenAI has become more than a fight over documents. It is now a blunt contest over who gets to hire — and keep — the engineers shaping the next generation of AI.
Apple filed suit in July, alleging former employees who joined OpenAI took confidential material tied to its hardware plans. The company’s complaint names former engineer Chang Liu and argues that the AI lab benefited from information it had no right to possess. OpenAI says Apple is recasting ordinary employee departures and broad product-development knowledge as theft. 1
The dispute escalated Monday when Apple sought a preliminary injunction that would bar OpenAI and the named employees from accessing, using or disclosing the alleged secrets while the litigation proceeds. The request could force an early judicial test of Apple’s claims before the broader case reaches discovery. 2
OpenAI answered with a motion to dismiss, portraying Apple’s case as retaliation for a growing talent drain. Its filing says Apple “should not be permitted to use a baseless and pretextual lawsuit” to compensate for failures in retaining workers and integrating AI into its products. 3 The company also argues that Liu was helping former colleagues, not stealing files, and says it does not have — or want — Apple’s trade secrets.
Apple rejects that framing. A spokesperson said “significant evidence has emerged” that OpenAI employees wrongfully took secret, confidential information about unreleased technologies. 3 With Apple alleging that more than 400 alumni now work at OpenAI, both sides agree on one fact: this is also a talent-war case. They sharply disagree on whether that competition crossed a legal line.
Outside the courtroom, Elon Musk distilled the suspicion into a terse post: “Can’t trust OpenAI.”
